Terms and Conditions

Welcome to Orbiting Art initiative. By accessing our website or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully. These are the Definitions, Terms and Conditions for the "Orbiting Art" initiative of SpaceCultural Center, a vertical of AnanthaP Research Private Limited.

Participation Fee

  1. The participation fee for the Sending your art to space and the drawing competition is Rs.1000/- including GST.

  2. This fee will entitle the participants to enter the competition and will contribute towards the prize pool and orbital launch and associated expenses.

Definitions

  1. The definition of art work typically refers to visual creation produced by the participants, using various drawing techniques and mediums.

  2. Art work submitted for the competition may include illustrations, sketches, paintings, or other forms of two-dimensional visual expressions created through the use of pencils, pens, charcoal, pastels, Markers or Digital Tools.

  3. AI generated images shall not be considered as an art form.

  4. No copyrighted material

  5. Do not contain threatening, offensive or abusive materials

  6. Do not contain obscenities, objectionable material, defames or invades the publicity or privacy of any person, living or deceased, or otherwise infringes upon any third party's personal or proprietary rights, publicity rights.

  7. Must comply with the themes, rules and regulations.

  8. Scanned Image must have a min resolution of 1080p

  9. Must have a max size not more than 10 Mb.

  10. Shall be in the format of REGULAR A4 size paper. NO OTHER SIZES ARE PERMITTED

  11. Art Work must be sent to the Designated Address to be considered for Competition.

  12. The Competition might be closed before the due date in the event of excess drawings received and is subject to change from time to time.

  13. The art work in print format is planned to be sent to space on India's First Private Orbital Launch. In the event of failure of such launch, where the art work does not reach space, further attempts will be sent in subsequent launches.

  14. The art work is not intended to create Space Debris. Hence the art work is not going to be ejected into space but will be part of the upper stage of the launch vehicle in space and will de-orbit as per the international norms.

  15. All attempts are made to provide the live link of the location of the Drawings. However such attempts might face difficulties in updation, or even sometimes, it might not be possible to provide the link, due to unforeseen consequences.

User Restrictions

  1. You must be at least 18 years old to participate in the "Orbiting Art" initiative.

  2. You are responsible for ensuring that your artwork complies with all applicable laws and does not infringe upon the rights of others.

  3. You grant SpaceCultural Center, AnanthaP Research Private Limited, a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, display, sell and perform the artworks submitted as part of the initiative, in connection with the service provided by AnanthaP Research Private Limited/SpaceCultural Center/Orbiting Art.

Rules of Conduct

By using our Service, you agree not to:

  1. Upload, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  2. Harm minors in any way.

  3. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

  4. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the service.

  5. Upload, post, email, or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.

Limitation of Liability and Disclaimer of Warranties

AnanthaP Research Private Limited/SpaceCultural Center/Orbiting Art and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; (iii) any content obtained from the service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

THE SERVICE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT.

Effective Date

These Terms and Conditions are effective as of 15th March 2024 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page.

Cancellation and Refund

Thank you for participating in SpaceCultural Center's "Orbiting Art" initiative. We understand that plans can change, and we strive to be as flexible as possible. The following policy outlines the terms regarding the cancellation of your submission or participation.

Cancellation by Participants

  • Submission Withdrawal: Participants may withdraw their art submission without any penalty up to 48 hours after the submission of the art work online. To cancel your submission, please contact us at info@spaceculture.ai

  • Refunds: If applicable, refunds for any fees paid for participation or additional services will be processed within 7 working days of the cancellation request. Refunds are subject to a 50% cancellation fee to cover processing costs.

  • Late Cancellation: Cancellations made less than more than 48 hours after submission online are not eligible for a refund. However, exceptions may be made on a case-by-case basis for extenuating circumstances.
     

Cancellation by SpaceCultural Center

  • Event Cancellation or Rescheduling: In the rare event that the "Orbiting Art" initiative must be rescheduled due to unforeseen circumstances, participants will be notified as soon as possible via the contact information provided at submission.

  • Liability: AnanthaP Research Private Limited/SpaceCultural Center/Orbiting Art is not responsible for any incidental expenses or consequential losses that participants may incur as a result of the planned event rescheduling, such as travel expenses, accommodations, or any other costs.

Shipping and Delivery

Online Submissions

For digital art submissions:

  • Participants can submit their artwork through our official website.

  • Upon submission, participants will receive an acknowledgment email confirming the receipt of their artwork.

  • The fees associated with online submissions need to be paid accordingly.

  • The artwork will be sent to space after consolidation. Digital Certificates will be provided after the launch. Physical certificates can be collected at the event of prize distribution which will be announced after the launch.

Physical Art Submissions

Participants need to send physical artwork to be eligible for the competition, which will lead to prizes.

Shipping Methods

  • Artworks should be sent through secured postal means.

  • Participants are responsible for shipping costs, including insurance.

  • We recommend that you use a trackable shipping service or purchase shipping insurance. We don’t guarantee that we will receive your returned item.

Packaging

  • Please package your artwork securely to prevent damage during transit. Use protective wrapping and strong, size-appropriate packaging materials.

  • Clearly label the package with the event's address, provided at the time of submission acceptance and your return address.

Shipping Timeline

  • All physical submissions must be received by deadlines as mentioned on the website.

  • Once your artwork arrives, you will receive a confirmation email from us acknowledging its receipt. The confirmation might take upto 14 working days.

Customs and Duties

  • For international shipments, participants are responsible for any customs and import taxes that may apply. We are not responsible for delays due to customs.

Lost or Damaged Items

  • AnanthaP Research Private Limited/SpaceCultural Center/Orbiting Art is not liable for any items lost or damaged in transit. If your artwork is lost or arrives damaged, please contact the shipping carrier to file a claim.

  • In the case of damage, please also notify us at our email address at the link with details of the issue.

Changes to This Policy

We may update our Shipping and Delivery Policy from time to time. We will notify you of any changes by posting the new policy on this page. You are advised to review this Shipping and Delivery Policy periodically for any changes.

Changes to Terms & Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
